Terms of Service
This is the agreement between you and Instdate. It covers what the app does for you, what you are responsible for, and the risks you take on when you connect your Instagram account.
Last updated 12 August 2026. Effective on the date you create an account or first use the app.
The most important term, first. Instdate acts on your Instagram account, using your credentials, at your instruction. Meta restricts automated access to Instagram. Using Instdate may put your Instagram account at risk of restriction, suspension or permanent loss, and we cannot prevent that or get your account back. Every message sent from your account is your message and your responsibility. If that is not a risk you want to take, do not connect your account.
1. Who this is between
"Instdate", "we" and "us" mean the operator of the Instdate app. "You" means the person who holds an Instdate account. Contact: hello@instdate.com.
By creating an account, subscribing, or using the app, you agree to these terms. If you do not agree, do not use Instdate.
2. Who can use Instdate
- You must be 18 or older. Instdate is a dating product and is not available to minors under any circumstances. If we learn an account belongs to someone under 18, we close it.
- You must have the legal capacity to enter a contract, and you must not be barred from using the service under any applicable law.
- You must own, and be authorised to use, the Instagram account you connect.
- One person, one account. Do not share your account or sell access to it.
3. What Instdate does
Instdate finds people who share your interests, using information those people have made public, and helps you start a conversation with them on Instagram. Depending on your plan, it drafts an opening message for you to send yourself, or sends and follows up on your behalf from your connected account.
Instdate matches on interests, not on appearance. We do not analyse photographs to assess how anyone looks, and we do not rank or filter people by attractiveness or by any physical or demographic characteristic inferred from an image.
Instdate is a tool for making introductions. It is not a matchmaking guarantee, an introduction service with a promised outcome, or a background-checking service. See section 6.
4. Your Instagram account, and the risk you are accepting
This section is the one most likely to affect you. Read it before you connect anything.
- You appoint us to act for you. When you connect your Instagram account, you authorise Instdate to access it and to take actions on it on your behalf — reading conversations, sending messages, and following up — within whatever limits your plan and your settings define. You can withdraw that authority at any time by disconnecting your account in Settings.
- Everything sent from your account is yours. A message Instdate sends for you is, as between you and us and as between you and the person receiving it, a message from you. You are responsible for it as if you had typed it. This is true whether you approved the exact wording, approved a draft, or configured Instdate to send without a further approval step.
- Meta restricts automated access, and we are not affiliated with them. Instdate is not affiliated with, endorsed by, sponsored by or connected to Instagram or Meta Platforms, Inc. Meta's terms restrict automated and third-party access to Instagram accounts. Using Instdate may breach those terms.
- You accept the consequences for your Instagram account. Those consequences can include reduced reach, temporary restrictions on messaging, suspension, and permanent loss of the account and everything in it. We cannot appeal on your behalf, cannot restore an account, and are not liable for the loss of one. You accept this risk knowingly when you connect.
- You remain responsible for your own compliance with Instagram's terms and with any other platform you use through Instdate.
We do not promise that the connection will keep working. Meta can change its systems or block access at any time, and if that happens the parts of Instdate that depend on the connection will stop working. That is not a failure we can undertake to fix, and section 9 covers what happens to your subscription if it becomes permanent.
5. How you must behave
You are talking to real people. Everything below applies to messages Instdate sends for you exactly as it applies to messages you type.
- If someone asks you to stop, stop. Do not contact them again, through Instdate or otherwise. If someone does not reply, that is an answer.
- Do not harass, threaten, intimidate, stalk, defame or abuse anyone.
- Do not impersonate anyone, misrepresent who you are, or use another person's photographs or identity.
- Do not contact anyone under 18, and do not use Instdate to look for them.
- Do not send sexually explicit, hateful, discriminatory or violent content.
- Do not use Instdate for commercial solicitation, advertising, recruitment, spam, scams, or to promote anything.
- Do not use Instdate to collect, scrape, store or resell information about the people it shows you.
- Do not attempt to reverse-engineer, interfere with, overload or gain unauthorised access to the service.
- Do not use Instdate for anything illegal where you are, or where the person you are contacting is.
We can end your access immediately and without refund if you break this section. We do not owe you a warning first, and we may report conduct to law enforcement where we are required to or believe someone is at risk.
6. We do not check anyone, and we do not promise outcomes
- We do not run background checks, identity verification or criminal record screening on anyone Instdate shows you, and we do not verify that any person is who their profile says they are.
- We do not guarantee matches, replies, dates, relationships, or any other outcome. Nobody is obliged to answer you.
- We do not guarantee that any particular person is on the platform, is single, is interested, or is real.
- You are responsible for your own safety when you meet anyone in person. Take the precautions you would take meeting any stranger: meet in public, tell someone where you are going, arrange your own transport.
Instdate is not responsible for the conduct of any person you meet through it, online or offline.
7. Subscriptions, billing and cancellation
- Plans and prices. Starter is €49 per month, Copilot €149 per month, and Concierge €249 per month. The plan you choose, and what it includes, is shown before you pay.
- Subscriptions renew automatically every month at the price above, charged to your payment method, until you cancel. By subscribing you consent to that recurring charge.
- Cancel any time, in Settings in the app or by emailing hello@instdate.com. Cancellation takes effect at the end of the period you have already paid for; you keep access until then and are not charged again.
- We tell you before a price changes, at least 30 days ahead, and a price change never applies to a period you have already paid for. If you do not want the new price, cancel before it takes effect.
- Payments are handled by Stripe under Stripe's own terms. We do not receive or store your full card details.
- Refunds. If you are a consumer in the EU or UK you have 14 days from your first payment to withdraw for any reason and get a full refund. Outside that, we refund when we have failed to deliver what you paid for — email us and say what happened. Nothing here limits any refund right you have under the law where you live.
8. Your content and your data
What you write stays yours. You grant us only the permission we need to run the service for you: to store your messages and drafts, to send them from your connected account when you have asked us to, and to display them back to you.
How we handle personal data, why, and the rights you have over it are set out in the Privacy Policy, which forms part of this agreement.
You can delete your Instdate account and everything attached to it from Settings, at any time, without asking us.
9. Availability, changes and ending the agreement
- We aim to keep Instdate running but do not promise uninterrupted availability. Maintenance, faults and third-party outages happen.
- We may change or withdraw features. If a change materially reduces what you are paying for, you may cancel and we refund the unused part of the period you have paid for.
- You may stop at any time by cancelling and deleting your account.
- We may suspend or end your access for breach of these terms, for non-payment, or if we stop offering the service. If we end it for any reason other than your breach, we refund the unused part of your current period.
10. Disclaimers and liability
Instdate is provided as it is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We are not liable for: the loss, restriction or suspension of your Instagram account; the conduct of anyone you contact or meet; a decision you make based on what the app showed you; or Meta changing or blocking access.
To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss, lost profits, or lost opportunity.
Nothing in these terms limits liability that cannot legally be limited — including for death or personal injury caused by negligence, for fraud, or for anything else that the law where you live does not permit us to exclude. If you are a consumer, your statutory rights are unaffected by anything written here.
11. Indemnity
If someone brings a claim against us because of how you used Instdate — the messages you sent, how you treated somebody, or your breach of these terms or of Instagram's — you agree to cover the reasonable costs and damages we incur as a result, except to the extent the claim arises from our own fault.
12. Law, disputes and changes to these terms
- These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory law of the country you live in, and you may bring proceedings in your own courts.
- Talk to us first — most problems are faster to fix by email than by lawyers. Consumers in the EU may also use the European Commission's online dispute resolution platform.
- We may update these terms. If a change is material we will tell account holders before it takes effect, and continuing to use Instdate after that date means you accept it. If you do not, cancel.
- If any part of these terms is unenforceable, the rest continues to apply.
